Where an automobile driver approaching an intersection at a lawful rate of speed looked to the left when about six feet from the intersection but failed to see defendants car, and after proceeding about three feet into the intersection looked again, this time seeing it about 25 feet east of the intersection coming at a rate of approximately 35 to 40 miles per hour, such driver could assume, until observation indicated the contrary, that defendant would yield her the right of way; and her act of continuing across the intersection did not constitute, under all the circumstances, contributory negligence as a matter of law. Defendants negligence was for the jury.
